Let’s talk about evictions.
You put a tenant in your home, and you’re not currently using a property manager, but your tenant has stopped paying rent, and you need to know what to do.
Today, we’re discussing your options and our own eviction process. If you want to do your own eviction, you can hire an attorney. You will likely need to come to Jacksonville and represent yourself in court. This process can last between 10 days and five or six weeks, depending on the situation.
Post a Three Day Notice to Pay or Quit
Your first step is to deliver a Three Day Notice. Post this on the front door of the property. If you live out of town and you’re doing this yourself, you have to personally deliver the notice. You are required to knock on the door. You cannot simply tape it on there and run off.
File the Eviction in Court
After you post the notice, your tenant has three business days to pay you the overdue rent. If you do not receive the payment, you should send the file to your attorney. Most of the time, attorneys charge between $1,700 and $2,500 for the process. You’ll need to file with the city and the county, and then the tenant will be served with the lawsuit.
Once served, your tenant has five business days to respond. If they don’t respond, the case goes back to the judge, and we get possession of the home. If the tenant does respond and deposit money with the clerk of the court, there will be a date set for the hearing. It can be in the next two weeks or five weeks later, depending on how backed up the court is.
